1. Introduction 

These Terms & Conditions (“Terms”) govern your access to and use of yanfloral.com (the “Site”) and all products or services provided by Yan Floral (“Yan Floral,” “we,” “us,” or “our”). By visiting the Site, placing an order, or otherwise using our services, you agree to be bound by these Terms and our Privacy, Shipping, and Refund Policies (collectively, the “Agreement”). If you do not agree, please do not use the Site. 
 

2. Eligibility 

You must be at least 18 years old (or the age of majority in your jurisdiction) and capable of forming a legally binding contract to use our services. By ordering, you represent that you meet these requirements. 
 

3. Products & Pricing 

• All arrangements are subject to seasonal availability. We reserve the right to substitute flowers or packaging of equal or greater value while preserving the style and color palette. 

• Prices, fees, and promotions are listed in U.S. dollars and may change without notice until you place your order. 

• Sales tax is applied where required by law. 
   

4. Orders, Payment & Delivery 

• Orders are accepted online or by phone. Full payment is due at checkout; we accept the payment methods displayed on the Site. 

• Once we have begun preparing your order, changes or cancellations are subject to our Refund Policy. 

• Delivery areas, timeframes, and fees are outlined in our Shipping Policy. Delivery is complete when the arrangement is handed to the recipient, left in a safe place, or received by an agent (e.g., receptionist or neighbor). 
   

5. Account Security 

You are responsible for maintaining the confidentiality of any account credentials and for all activities that occur under your account. Notify us immediately of any unauthorized use. 
 

6. Intellectual Property 

All content on the Site — including photos, text, graphics, and logos — is owned by Yan Floral or our licensors and protected by copyright, trademark, and other laws. 7. User Content 

If you submit reviews, photos, or other materials (“User Content”): 

• You grant Yan Floral a non-exclusive, royalty-free, perpetual, and worldwide license to use, display, and distribute that content in any media. 

• You confirm that you own or have the right to share the User Content and that it does not infringe any third-party rights. 
  We reserve the right to remove or edit User Content at our discretion. 
   

8. Prohibited Conduct 

You agree not to: 

• Use the Site for any unlawful purpose or in violation of these Terms. 

• Post or transmit any harmful, fraudulent, defamatory, obscene, or otherwise objectionable content. 

• Interfere with the security or operation of the Site, including introducing viruses or hacking.

9. Disclaimer of Warranties 

Our products are perishable and may vary slightly from photos. Except as expressly stated in our policies, the Site and services are provided “as is” without warranties of any kind, either express or implied, including merchantability, fitness for a particular purpose, or non-infringement. Applicable law may not allow the exclusion of implied warranties, so some exclusions may not apply to you. 
 

10. Limitation of Liability 

To the fullest extent permitted by law, Yan Floral will not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues arising out of or related to your use of the Site or our products, even if we have been advised of the possibility of such damages. Our total liability to you for any claim will not exceed the amount you paid for the order in question. 
 

11. Indemnification 

You agree to indemnify, defend, and hold harmless Yan Floral and its owners, employees, and agents from any claim, demand, or damages arising out of (a) your breach of these Terms, (b) your misuse of the Site, or (c) your violation of any law or third-party rights. 
 

12. Governing Law & Dispute Resolution 

These Terms are governed by the laws of the State of California (without regard to conflict-of-law principles). Any dispute arising under or relating to the Agreement shall be resolved exclusively in the state or federal courts located in Fresno County, CA and you consent to the jurisdiction of those courts. 
 

13. Severability 

If any provision of these Terms is held to be unlawful or unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force. 
 

14. Changes to These Terms 

We may modify these Terms at any time. If we make material changes, we will post the updated Terms on the Site and update the “Last updated” date. Continued use of the Site after changes means you accept the revised Terms.
